Construction Contractor Compliance & 16 Affirmative Action Steps

For companies with 15 or more employees holding federal or federally-assisted contracts or subcontracts over $10,000, compliance with the "16 Affirmative Action Steps" is mandatory. These steps are detailed in the FHWA 1273 for federal highway construction contractors and are included in most state Department of Transportation contracts.

While written Affirmative Action Programs (AAPs) for minorities and females are not required for construction contracts, contractors still have many similar obligations as Service & Supply Contractors.

These include:

  • Good-faith recruiting and selection of minorities and females
  • Work-hour utilization analyses
  • Impact Ratio Analyses
  • Periodic EEO/Affirmative Action/Anti-Harassment Training
  • Other workforce assessment and development obligations

For direct federal construction contracts or subcontracts (such as federal buildings, VA hospitals, military facilities, Interstates, etc.), contractors are required to develop and execute written AAPs for Veterans and Individuals with Disabilities.
